Global Kaos Pty Ltd (ABN 70 106 144 067) trading as Turnip Nutrition ("Turnip Nutrition", "we", "us" or "our") is committed to protecting your privacy and handling your personal information in an open and transparent way.

This Privacy Policy explains how we collect, hold, use, disclose and protect your personal information when you visit our website, engage our clinical nutrition services, purchase our products, or otherwise interact with us. It also explains your rights in relation to your personal information and how to contact us if you have a question or concern.

By using our website or our services, you acknowledge that you have read and understood this Privacy Policy.

2. Who this policy applies to and our legal obligations

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Importantly, because Turnip Nutrition provides a health service (clinical nutrition consultations) and holds health information, we are required to comply with the Privacy Act and the APPs regardless of our annual turnover. The small business exemption that applies to some other businesses does not apply to us. We take this responsibility seriously.

Health information is treated as "sensitive information" under the Privacy Act, which means it is given a higher level of protection than ordinary personal information.

3. The information we collect

The types of personal information we collect depend on how you interact with us. This may include:

Identity and contact information Your name, email address, postal address, telephone number, date of birth and emergency contact details.

Health and sensitive information As part of providing nutrition consultations, we collect health information such as your medical history, symptoms, current and past health conditions, medications and supplements, pathology and test results, dietary intake and preferences, lifestyle factors, family health history, and any other information you provide during your consultations or in intake and health history forms.

Transaction and payment information Records of the products, programs, courses and consultations you have purchased. When you make a payment, your card and billing details are collected and processed directly by our third-party payment processors (Stripe and PayPal). We do not store your full payment card details on our systems.

Account and community information If you join our online community, membership or course platforms, we collect account details such as your username, profile information, the content you post or share, and your activity and progress within courses or the community.

Communications Records of your communications with us, including emails, enquiry and contact form submissions, feedback, and survey responses.

Technical and usage information When you visit our website, we may automatically collect information such as your IP address, browser type, device information, operating system, the pages you view, the links you click, and the date and time of your visit. This is collected through cookies and similar technologies (see Section 8).

4. How we collect your information

We collect personal information in a number of ways, including:

  • Directly from you when you complete a booking, intake or health history form, purchase a product or service, subscribe to our newsletter, create an account, contact us, or interact with us during consultations.

  • Through our website and the third-party platforms we use to run our business (see Section 9).

  • Through cookies and analytics tools when you use our website.

  • From third parties where you have consented or where we are otherwise permitted by law (for example, a referring health practitioner).

Wherever it is reasonable and practicable to do so, we collect personal information directly from you.

5. Why we collect, hold, use and disclose your information

We collect, hold, use and disclose your personal information for purposes including:

  • Providing clinical nutrition consultations and developing personalised nutrition plans and recommendations.

  • Creating and managing your client records and appointments.

  • Processing your purchases and delivering the products, programs, courses and community access you have bought.

  • Communicating with you about your bookings, purchases, accounts and enquiries.

  • Sending you newsletters, updates and marketing communications where you have consented (see Section 11).

  • Managing, improving and personalising our website, products and services.

  • Meeting our legal, regulatory and professional obligations.

We will only use or disclose your personal information for the purpose for which it was collected, for a directly related purpose you would reasonably expect, or where you have consented, or where we are otherwise permitted or required by law.

6. Sensitive and health information - your consent

Because health information is sensitive information, we will only collect it with your consent and where it is reasonably necessary for us to provide our services to you.

By providing us with your health information through our intake forms, consultations or otherwise, you consent to us collecting, holding, using and disclosing that information for the purpose of providing nutrition care to you and as otherwise described in this policy. You can withdraw your consent at any time by contacting us, though please note this may affect our ability to provide our services to you.

7. Cookies, analytics and online tracking

Our website uses cookies and similar tracking technologies to function properly, to remember your preferences, to understand how visitors use our site, and to support our marketing.

We use the following types of tools:

  • Essential cookies that are necessary for the website to operate.

  • Analytics tools, including Google Analytics, which help us understand how visitors find and use our website.

  • Advertising and marketing pixels, including the Meta (Facebook) Pixel and the Pinterest Tag, which help us measure and improve the effectiveness of our advertising and show relevant content to you on those platforms.

When you first visit our website, you will be presented with a cookie banner allowing you to manage your cookie preferences. You can also control cookies through your browser settings. Disabling certain cookies may affect how parts of our website function.

8. The platforms and third parties we share your information with

We use a number of trusted third-party service providers to run our business. We only share the information reasonably necessary for them to perform their services, and we take reasonable steps to ensure they handle your information appropriately. These include:

  • Squarespace - our website hosting and management platform.

  • Halaxy - our practice management and online booking system, which stores client records, appointment details and health information.

  • ThriveCart (including Learn+) - our checkout and order management system, used for selling and delivering some of our products, programs and courses.

  • Heartbeat - our online community platform and learning hub / course portal, used to deliver community access and course content.

  • Stripe+ - our payment processor, used to process payments (including payments made through Halaxy, ThriveCart and Heartbeat). Stripe+ provides many payment options.

  • PayPal - a payment option available at checkout through stripe+

  • MailerLite - our email marketing platform, used to send newsletters and communications and to manage subscriptions.

  • Google (including Google Analytics), Meta (Facebook) and Pinterest - for website analytics and advertising.

We may also disclose your personal information to professional advisers (such as accountants or lawyers), to other health practitioners involved in your care where you have consented, and to government or regulatory bodies where required or authorised by law.

We do not sell your personal information.

9. Overseas disclosure

Some of the third-party providers listed above are located, or store data, outside Australia - for example in the United States, the European Union, or other countries. This means your personal information may be disclosed to, and stored in, overseas locations.

Where we disclose personal information overseas, we take reasonable steps to ensure that the recipient handles your information in a manner consistent with the Australian Privacy Principles, including by relying on the privacy and security commitments made by these established providers.

10. Direct marketing and how to opt out

With your consent, we may send you marketing communications such as our newsletter, offers and updates about our products and services, primarily by email via MailerLite.

You can opt out of receiving marketing communications at any time by clicking the "unsubscribe" link in any email we send you, or by contacting us directly. We will action your request promptly. Please note that even if you opt out of marketing, we may still need to contact you about your bookings, purchases or accounts for service and administrative reasons.

11. How we store and protect your information

We take reasonable technical and organisational measures to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure.

These measures include storing information within secure, access-controlled platforms, limiting access to your information to those who need it, and choosing reputable service providers with appropriate security practices. While we strive to protect your information, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.

12. How long we keep your information

We keep your personal information only for as long as necessary for the purposes for which it was collected, or as required by law.

In line with professional and legal requirements, we retain client health records for a minimum of seven (7) years from the date of your last consultation or contact with us. Where you are or were a minor at the time of treatment, records are retained for longer in accordance with applicable requirements. When information is no longer required, we take reasonable steps to securely destroy or de-identify it.

13. Accessing and correcting your information

You have the right to request access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.

To make a request, please contact us using the details in Section 18. We will respond within a reasonable period. There is generally no charge for making a request, although we may charge a reasonable fee for providing access in certain circumstances. We may need to verify your identity before actioning your request.

In limited circumstances we may decline a request as permitted by law - if we do, we will explain why in writing.

14. International users (UK and EU) - GDPR

If you are located in the United Kingdom or the European Economic Area, the UK GDPR and EU General Data Protection Regulation (GDPR) may apply to our handling of your personal data, in addition to our obligations under Australian law.

Where the GDPR applies, we rely on one or more of the following lawful bases to process your personal data: your consent; the performance of a contract with you (such as providing the services you have purchased); compliance with a legal obligation; or our legitimate interests, provided these are not overridden by your rights.

Where we process special category data (such as health data), we do so on the basis of your explicit consent or another applicable lawful basis.

If the GDPR applies to you, you have the right to: access your personal data; request correction or erasure; restrict or object to processing; data portability; and withdraw consent at any time. You also have the right to lodge a complaint with your local data protection authority. To exercise any of these rights, please contact us using the details in Section 18.

15. Children's privacy

Our website and services are directed to adults and are not intended for children. We do not knowingly collect personal information from children without the consent of a parent or guardian. If you believe we have collected information from a child without appropriate consent, please contact us and we will take steps to delete it.

We have procedures in place to respond to data breaches. If a data breach occurs that is likely to result in serious harm to any individual whose personal information is involved, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.

We do not use automated processes or artificial intelligence to make decisions that have a significant or legal effect on you. Any decisions about your care or services involve a real person.

Information provided through our website, blog, newsletters, ebooks, courses, programs and community is general in nature and is for educational purposes only. It is not a substitute for individual medical advice, diagnosis or treatment from a qualified healthcare professional. Personalised advice is provided only within a formal consultation relationship.
